Terms of Use

1. Acceptance and scope

These Terms of Use (“Terms”) govern your access to and use of The Collection website and its waitlist (collectively, the “Site”). The Collection is a brand operated by JD Productions Inc. (“JD Productions,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site or submit information through it.

2. The waitlist

The Collection waitlist is an expression of interest in future Collection communications. It is not an offer, contract for sale, reservation, guarantee of admission, guarantee of access, purchase opportunity, product promise, or commitment to a launch date, price, or availability.

We may open, pause, change, limit, or close the waitlist and may decide whether, when, and how to contact waitlist participants. You may unsubscribe from Collection emails at any time through the unsubscribe link in those emails.

3. Eligibility and permitted use

You may use the Site only for lawful, personal, non-commercial purposes and only if you are able to form a binding agreement under applicable law. The waitlist is not directed to children under 13.

You may not, and may not help anyone else to:

• submit false, misleading, or unauthorized email addresses or other information;
• use automated systems, bots, scrapers, or data-mining tools to access, copy, monitor, or interact with the Site;
• interfere with, circumvent, probe, or attempt unauthorized access to the Site or its security measures;
• introduce harmful code, overload the Site, or use it in a manner that could impair availability; or
• use the Site in violation of applicable law or another person’s rights.

4. Intellectual property

Except where expressly identified otherwise, the Collection name, Collection mark, site design, text, software, and other original materials on the Site are owned by or licensed to JD Productions and are protected by applicable intellectual-property laws. These Terms grant you a limited, revocable, non-transferable right to view the Site for personal, non-commercial use only.

You may not copy, reproduce, modify, distribute, publicly display, create derivative works from, reverse engineer, or commercially exploit any part of the Site without prior written permission from JD Productions. Some materials displayed on the Site may be used under separate third-party permissions or licenses; all rights in those materials remain with their respective owners and applicable license terms control their use.

5. Third-party services and links

The Site may rely on third-party technology providers to host the Site, store waitlist records, or deliver email. Those providers operate under their own terms and privacy policies. We are not responsible for third-party websites, content, services, or practices that are not under our control, even if the Site contains a link to them.

6. Availability, changes, and communications

The Collection is in development. We may modify, suspend, withdraw, or discontinue any part of the Site or waitlist at any time, with or without notice. We do not guarantee that the Site will be available, uninterrupted, secure, or error-free at any particular time.

If you voluntarily join the waitlist, you consent to receive Collection communications at the email address you provide, subject to your right to unsubscribe. Your use of the Site is also governed by our Privacy Policy.

7. Disclaimers

THE SITE AND WAITLIST ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, JD PRODUCTIONS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Nothing on the Site is a promise or guarantee about a future Collection release, product, price, timing, or availability.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JD PRODUCTIONS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS. Nothing in these Terms limits liability that cannot legally be limited or excluded.

9. Governing law and venue

These Terms and any dispute arising out of or relating to the Site are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Subject to applicable law, any action or proceeding relating to the Site or these Terms must be brought in the state or federal courts located in Hillsborough County, Florida, and you consent to their jurisdiction.

10. Changes, severability, and contact

We may revise these Terms as the Collection evolves. Revised Terms are effective when posted with an updated date. If a provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it.
